RESUMO: Um grupo de irmãos da Santa Casa da Misericórdia de Montargil (SCMM), Ponte de Sôr, Arquidiocese de Évora, solicitou a intervenção do Arcebispo, como tutela religiosa, para demitir alguns irmãos dos cargos directivos, por crime de «burla, burla agravada e falsificação de documentos, delitos cometidos no exercício das referidas funções». O Prelado nomeou um Delegado para dialogar com a Mesa Administrativa e resolver a questão. Tal não foi possível por não existir acordo sobre o modo como deviam ser classificadas juridicamente as Misericórdias. Associações públicas de fiéis ou, simplesmente, associações privadas de fiéis? Rejeitado o Decreto do Prelado que exonerava dos seus cargos os respectivos membros da SCMM, houve lugar a sucessivos recursos para o Pontifício Conselho para os Leigos e para o Supremo Tribunal da Assinatura Apostólica. A decisão acerca da matéria, quer in decernendo quer in procedendo, foi sempre favorável ao Prelado e a conclusão final assenta no facto de a SCMM dever ser considerada uma associação pública de fiéis.

ABSTRACT: A group of brothers from the Santa Casa da Misericórdia de Montargil” (SCMM), Ponte de Sôr, Archdiocese of Évora, requested that the archbishop, as the religious guardian, dismiss some brothers from the board of directors for “fraud, serious fraud and forgery of documents, crimes committed while exercising their respective functions”. The archbishop appointed a commission agent to discuss the subject with the board of directors and reach a decision. This was not possible as there was no agreement on the way for Misericórdias to be classified in legal terms. Are they public associations of parishioners or, simply, private associations of parishioners? Having rejected the archbishop’s order relieving the respective members of the SCMM from their positions, there were successive petitions to the Pontifical Layperson’s Council and the Supreme Court of the Apostolic Signature. The decision, both in decernendo and in procedendo, always supported the archbishop and the final decision is based on the fact that the SCMM is considered to be a public association of parishioners.
